The Court found New York's action to ban MTBE is not preempted by federal law, arguing that states do have the constitutional right to ban MTBE due to water contamination concerns. While the legal questions appear to be resolved with this decision, there will still be a trial on the factual question of whether the MTBE ban threatens the efficient operation of reformulated gasoline markets as envisioned by Congress.
